Q: What do I say when police officers want to ask me questions?
Even if you did not do anything illegal and authorities have said you are not a suspect in a criminal case, you need to understand that there are several risks to speaking openly with law enforcement. You always have the right to remain silent and it is generally recommended that you not try to explain yourself until you have legal representation. Q: When must the police advise me of my rights?
Miranda v. Arizona, 384 U.S. 436, 86 S. Ct. 1602 (1966) was the United States Supreme Court case which led to the creation of Miranda rights that require police officers to inform alleged offenders of their rights to remain silent and have a lawyer present for any questioning as well as a court appointing a lawyer if a person cannot afford one and any statements a person making being used against them in a court of law. It does not apply to all cases. Please contact Mark Diaz & Associates to discuss your case.

Q: Do I need to hire a criminal defense lawyer for a misdemeanor?
It will usually be recommended that you retain legal counsel even when you are only facing misdemeanor charges. While a misdemeanor does not involve the same penalties as felony offenses, a conviction can still be incredibly damaging. You will want to be certain that you understand all of the consequences of a guilty plea and you may also want to try and fight the charges. Please contact Mark Diaz & Associates to discuss your case.

Q: What happens if I am convicted of a crime that I didn't commit?
It is not impossible for a judge or jury in Texas to make a mistake, but fortunately the state does allow people to appeal decisions they disagree with. When you file an appeal, you can ask a higher court to review your criminal cases and possible make changes when there are errors in the handling of a criminal case. Please contact Mark Diaz & Associates to discuss your case.

Q: What is the difference between probation and deferred adjudication?
The difference between these two terms generally relates to whether a conviction will be visible following court proceedings. When a person is placed on probation, it will usually be for a specific term and there will be complete records of a person’s criminal case. If a person receives deferred adjudication, then it may be possible for the alleged offender to have the record of the conviction hidden from the public. Please contact Mark Diaz & Associates to discuss your case.

This is late review but I used the services of Mark Diaz and associates back in Sept. 2024. Thomas Overhouse is awsome 🔥. Thomas had gave me consultation on my case that needed to be modified, that no other attorney wanted to touch. He wanted to be certain he would able to give me the results I wanted before they were to be compensated. He just didnt want to take my money and give false promises. Thank you!!!.

Jess and the entire team were so incredibly helpful and supportive every step of the way. They believed in us and fought hard to uncover and bring forth the truth, resulting in a legal grand slam home run! Case “no billed”. Worth every penny! 🙂

As an international, I was extremely panicked when I faced my case. I didn’t know where to turn or who to trust. After speaking with some local friends, I was guided to Mark Diaz’s office. From my very first meeting with Jessica and the team, I felt truly welcomed. They listened carefully, understood my situation with sincerity, and immediately took action to move my case forward. What impressed me most was their kindness, honesty, and integrity. They did not take advantage of my situation. In fact, they even reduced my fees. Before the case was even registered, they worked diligently with the DA’s office and successfully got it terminated. In my opinion, this team will always tell you upfront the best possible outcome they can achieve and then fight for you as if they were fighting for themselves. Their dedication, compassion, and professionalism are unmatched. If you are in trouble, don’t hesitate, go and meet them. They are true well-wishers who understand the seriousness of your situation and stand by you with heart and hard work. No amount of thanks will ever be enough for the way JESSICA and the team supported me. God bless you all!

This entire team was absolutely wonderful to work with. Where other attorney teams refused to listen, the Mark Diaz team stepped up. Not only did they take on my case, but they went out and fought for me. I simply shared with them the facts of the events that took place, and Ms. Jessica Ebbs pushed us to a Jury Trial and had the case dismissed entirely. I am eternally grateful. I highly recommend this team to anyone faced with a wrongful suit, or who may be facing consequences unequal to the facts of the matter. They truly care, and they truly put in the due diligence necessary to defend their clients. Thank you, Jessica! And, thank you, Mark Diaz team!
